ATM Operators ADA Protection Program

As an ATM operator, you’re subject to the stringent compliance requirements of the Americans with Disabilities Act. Since March 2012, all ATM machines are required to comply with the ADA Standards for Accessible Design of 2010, which includes requirements for speech capabilities, braille directions, headphone jacks, blank screen capabilities, unobstructed access, and specified heights and widths. Not convinced that the threat is real? An article in American Banker describes the extent of the private legal action that is just beginning to surface. A blind Texas woman represented by a “prolific” tort lawyer has sued 19 financial institutions for allegedly failing to meet ADA requirements. This lawyer’s other clients include a blind Pennsylvania man who has filed at least 20 ADA-related suits. While in several cases the financial institutions were able to avoid paying damages by agreeing to bring their ATM machines into compliance, they still had to pay “tens of thousands” of dollars in legal fees. And, it appears that these law suits are only the tip of the iceberg.

The ATM Operators ADA Protection Program features:
Protection limits of $50,000 per ATM, $500,000 per ATM operator, and up to $5 million for any ATM processor
A "discovery made" policy—to be covered, ATMs just need to be protected under the program at the time you are notified of a suspected violation or legal action (not at the time the violation actually occurred)

Maestro ATM EMV Liability Shift Program

As an ATM operator with non-EMV capable machines, you’re at risk of accepting cross-border counterfeit Maestro ATM cards. That means you’re also at risk of taking on the potentially catastrophic costs of these fraudulent transactions.

Effective April 19, 2013, MasterCard® shifted the liability for transactions stemming from the use of cross-border counterfeit Maestro ATM cards in non-EMV capable ATM machines to the ATM operator. If your ATM machine accepts such a card, you are 100% liable for the costs of that fraudulent transaction—costs that can be high enough to present a serious financial risk to your business.

That’s why RGS Limited, LLC, the leading provider of insurance products to the payment card industry, is offering the Maestro ATM EMV Liability Shift Program, a unique program designed to protect ATM operators from the risks posed by counterfeit Maestro ATM cards during the transition to EMV.

The Maestro ATM EMV Liability Shift Program provides:
$50,000 or $100,000 in PCI-DSS protection for each ATM machine and up to $500,000 for any one ATM operator. PCI-DSS protection covers the following expenses: (1) a forensic audit when a data breach is suspected, (2) card replacement costs and related expenses, and (3) assessments and fines levied by card sponsors for data breaches.
A sublimit of $25,000 per ATM to cover the cost of fraudulent transactions resulting from a non-EMV capable machine accepting counterfeit cross-border Maestro cards.

The Maestro ATM EMV Liability Shift Program can be combined with the RGS ATM Operators ADA Protection Program, which protects ATM operators in the event of suspected violations of the ADA (Americans with Disabilities Act) Standards by one or more ATM machines.
